Now you have.

People often say: fail fast and fail smart. When it comes to taxes, however, there is no reason to fail at all.

This is precisely why it is so important to discuss tax issues in the digital era with clarity, foresight and practical relevance.

At the recent event Shaping the future: legal, tax and regulatory insights in new technologies, held in celebration of the 8th anniversary of LEXCELLENCE AG – Legal Services and co-organised with Clouds On Mars, our CEO Stéphanie Fuchs, contributed to the programme with a presentation on a topic that remains significantly underused and underestimated in practice: tax risk insurance.

LEXCELLENCE AG – Legal Services is a collaboration partner of Stéphanie Fuchs Consulting, and it was a pleasure to contribute to this special occasion with a subject that deserves far greater attention in advisory and transactional practice.

Tax risk insurance can be a highly practical tool where identified tax uncertainties arise, for example in the context of M&A transactions, restructurings, valuation issues or other complex tax positions. Under defined conditions, it allows the financial exposure connected with a challenged tax position to be transferred to the insurance market.

Despite its practical relevance, awareness of this instrument remains limited among many practitioners. 

In line with the broader focus of the event, the discussion also addressed two further questions at the intersection of technology and taxation.

The first concerned the robot-tax debate, which raises fundamental questions about productivity, labour taxation and the allocation of taxing rights in increasingly automated economies.

The second looked at data from a VAT perspective. Data has become a central economic asset of the digital economy, yet the question of how value should be assessed and treated for VAT purposes remains both complex and highly relevant in practice.

Technology evolves rapidly. Legal and tax frameworks require time to follow. That is exactly why discussions of this nature are not merely interesting. They are necessary.

It is amazing how much can change in a year, and this conversation really made us pause and reflect on Stéphanie’s journey as a founder.

For the first time since launching her own company, Stéphanie allowed herself to take a step back, not just to look at what she has achieved, but to really think about what she has learned. Speaking with Zack, who is incredibly experienced and successful in his field, was a powerful reminder that we are all always learning, no matter where we are on our paths.

A true honour to engage with the Shenzhen Qianhai delegation on cross-border taxation

At the end of November, our CEO had the honour of speaking with a distinguished delegation of senior officials from the Shenzhen Qianhai Authority during their visit to Switzerland.

Shenzhen, and in particular the Qianhai zone, stands out as one of the most dynamic environments globally for innovation, cross-border business and regulatory experimentation. This makes the dialogue with its representatives especially relevant when discussing taxation in technology-driven and international contexts.

The discussion quickly moved beyond classical tax questions. The real focus was on how technology is reshaping the foundations on which tax systems, governance models and regulatory frameworks are built.

Based on many years of cross-border advisory experience, several recurring pressure points are evident for Stéphanie. Artificial intelligence and automation are already embedded in operational and decision-making processes, increasingly also on the side of tax authorities. This fundamentally changes how substance, control and accountability need to be assessed.

Decentralised organisational models such as DAOs push these questions even further. They challenge traditional concepts of legal presence, while at the same time increasing the importance of robust governance frameworks and legally anchored structures, including Swiss associations and foundations.

Token-based business models illustrate another structural shift. Value creation is becoming more fluid, more distributed and harder to allocate along traditional geographic lines, raising new questions around qualification, valuation and cross-border taxation.

What connects all these developments is technology as a structural driver and the resulting need to align value creation, responsibility and taxation across borders in a coherent manner. It is discussions like these that address this coordination where it actually takes place, within economic and institutional systems.

The exchange took place within the framework of the United Nations Institute for Training and Research (UNITAR) Shenzhen Government Switzerland Study Visit, led by Mr Wen Ping, Deputy Director General of the Shenzhen Qianhai Authority, and organised by the Swiss FinTech Association (SFTA) under the leadership of Philip J. Weights at Tenity.

It was, as always, a great pleasure to speak about crypto taxation in the CCFE - Certified Crypto Finance Expert programme.


I truly appreciate this format. It carries a very particular energy, shaped by the dynamic interaction of Nadia Licci and Rino Borini.

The participants come from very diverse professional backgrounds, which makes each session both intensive and lively. This diversity is precisely what allows us to go into real depth on a highly specialised topic such as taxation, while at the same time staying close to the practical and very real questions that arise in practice.

Once again, the session provided a tour d’horizon of tax aspects relating to crypto assets, starting with
🖊️ the fundamental token categories and their tax qualification
🖊️ the distinction between income and capital gains
🖊️ the criteria for classification as a professional securities trader
and extending to

as well as the increasingly prevalent issue of crypto scams.

The session was fully booked. The openness of the group and the breadth of questions consistently give me the opportunity to sense and understand which topics are currently most relevant, where uncertainties remain, and which perspectives exist on tax matters. This exchange is, for me, the core value of these courses.

Our CEO summarizes:
It was a real honour to moderate the recent event of our fabulous Sustainability Working Group of the Crypto Valley Association together with Médecins Sans Frontières (Switzerland) and Etheros HealthData Foundation on Decentralized Healthcare in Geneva last week.

As the final contribution of our dear co-chair Carmen Cucul, MBA, and together with fellow co-chair Michele Soavi, Mirela Dimofte and the wonderful host of the evening Mario Stephan as well as our CVA president Jérôme Bailly and Olga Konchenkova, head of the Western Switzerland Chapter of the CVA, we explored how Blockchain & AI can improve patient experience and outcomes.

The collaboration with Médecins Sans Frontières Switzerland grounded the entire discussion in a humanitarian perspective. It demonstrated how responsible healthcare innovation begins with a clear understanding of what data represents and how it must be handled in the interest of patients.

🌿 The first panel led by Mirela Dimofte examined decentralized healthcare solutions. Caroline Perrin, Katarzyna Wac and Thierry Fumeaux offered clinical, scientific and operational perspectives that illustrated how secure and verifiable data flows can strengthen medical decision making and improve patient pathways.

One of my key takeaways was that data does not mean information. Data becomes useful only when it is interpreted, connected to the clinical context and applied by professionals who understand the needs of patients. This point shaped the way we approached the discussion on decentralized healthcare for the rest of the evening.

🌱 A deep dive into the technological aspects of the topic shaped the second panel. Arash Rafii Tabrizi, Charles Beauville and Eberhard Scheuer examined decentralized health data management from a technical point of view. Under the guidance of Carmen Cucul, they showed how patient-initiated research can broaden medical insight, how federated learning allows hospitals to train models without releasing data, how digital health records can support patients throughout their care and how permission systems can guide data access in complex clinical environments.

🍃 For me personally, the discussions added a depth that shaped the entire evening. I am grateful for the way in which the speakers shared their knowledge and connected their work to concrete medical and technical realities.

Together with Dr. Mira Bazlen, our CEO designed and delivered the webinar series “Crypto Tax Navigator” at ISIS) – Institute for Swiss and International Tax Law.
Across two lunch sessions, the tax and technological foundations of crypto-assets were examined in a structured and in-depth manner. The focus was placed on those precise interfaces where protocol logic and tax qualification directly intersect.

Part I covered in particular:

Breaking DePIN at TRUST SQUARE explored the question and set the stage for the CV Summit the following week.

The event brought together thought leaders, entrepreneurs and strategists from across the industry for a candid exchange of ideas and long-term visions.

Our CEO Stéphanie Fuchs delivered the keynote on "The fiscal code of DePIN and AI" and moderated the panel discussion on the Swiss policy edge. Speakers Thomas Nigg (onocoy), Diana Lafita (MLL Legal) and Salvatore Luciano Furnari (Lener & Partners) outlined why Switzerland has the opportunity not only to host but to anchor DePIN projects over the long term through a unique combination of expertise, legal certainty and a regulatory environment designed to enable innovation rather than obstruct it.

From a tax perspective, the challenge is to move from noise to high signal. The fiscal framework of DePIN and AI is taking shape and several aspects require close attention.
🔑 Unlocking the potential of dual structures
Many Swiss DePIN projects combine a corporation with a foundation or association. Structured wisely this combination proves helpful and efficient.

🔑 “We will just go offshore”
This trend has returned. Such a decision may be commercially justified, but an offshore entity should not be placed at the top of the structure unless it is supported by real substance. Swiss withholding tax is decisive. If dividends, interest or royalties are routed through an offshore layer, withholding tax may block the flow. Without proper relief and a robust beneficial ownership analysis, the offshore layer risks becoming a structural cost trap.

🔑 The new gold in taxation
It is not Bitcoin. Particularly in AI-driven projects, the decisive factor is often data. Data carries value and value entails tax consequences. For AI business models, data may function both as a revenue driver and as a tax driver. Questions of ownership, valuation and place of taxation will shape the fiscal outcome. The Meta case also illustrated the importance of monitoring VAT exposure carefully.
Breaking DePIN generated tangible momentum and demonstrated the strength of the Swiss ecosystem when tax, legal, technical and entrepreneurial expertise converge and translate ideas into execution.

Appreciation is extended to Mark Ballandies, Viola Bhattarai (Zoller) and the team for organizing this exceptional event, and to Alta Diaz for the excellent moderation.

If the objective is pole position, the tax track must be mastered and the right crew selected in the pit.

Certified Crypto Finance Expert (CCFE) - Taxation of Crypto Assets


Our CEO Stéphanie Fuchs had the privilege of speaking on a topic she is particularly passionate about: the taxation of digital assets, as part of the Certified Crypto Finance Expert training programme.

The session focused on practical questions around token structuring, proper tax classification, and the application of international reporting obligations under the Crypto-Asset Reporting Framework (CARF).
Using concrete case studies, she explained the tax implications of various transactions - from token issuance and airdrops to reporting obligations. A specially developed seven-point checklist served as a guide for the systematic assessment of complex scenarios.

What structures does decentralisation require? and how is blockchain reshaping access to capital and impact frameworks?

These questions were at the core of the panel moderated by our CEO Stéphanie Fuchs at the Crypto Valley Conference 2025 in Rotkreuz.

Under the title How blockchain is powering a more equitable future, she led a discussion with Jemma Green (Powerledger), Marieke Flament (UNICEF), and Tobias Huber (Siemens), exploring concrete use cases of blockchain technology — from decentralised energy markets and humanitarian supply chains to industrial infrastructure.

Beyond Energy. Decentralised Solutions for Climate Change


How can decentralised energy systems be designed to be effective, scalable and legally sound?

This question was at the heart of the evening event Beyond energy. decentralised solutions for climate change, which our CEO Stéphanie Fuchs co-organised and co-curated together with the Sustainability Working Group of the Crypto Valley Association and with the support of Powerledger.

The focus was not only on technological applications, but in particular on the institutional foundations for trust, stability and transparency: legal certainty, tax classification, and regulatory coherence.

As a panelist in the session Unlocking climate impact – policy and legal foundations for decentralised energy, Stéphanie Fuchs joined Alex Bardin and Matthias Hafner, moderated by Michele Soavi, to discuss which legal, tax and policy frameworks are required to ensure that the transition to decentralised energy models is viable and sustainable.

The evening made one thing clear: without a clear legal and fiscal framework, impact remains fragmented. With the right structures in place, it can become systemic.

Crypto in employee participation programmes – far beyond token valuation


On 22 May 2025, our CEO Stéphanie Fuchs gave a presentation together with Noëmi Kunz-Schenk from the cantonal tax authority of Lucerne at the Seminar hosted by the Institute for Swiss and International Tax Law.

The session focused on the tax implications of crypto-assets in contemporary employee participation models.
The presentation extended well beyond the valuation of individual tokens. Our CEO addressed how new decentralised structures – especially those emerging through DAOs and DePIN projects – are reshaping corporate governance, value creation, and collaboration.

Powering maritime progress – legal, tech and tax insights for a new era

The maritime sector is undergoing rapid transformation. From technological innovation to shifting geopolitical realities, the need for integrated legal and fiscal strategies has never been more pressing.

Our CEO Stéphanie Fuchs was invited to contribute tax insights at the international webinar “Maritime and Deep-Sea Tech. How to Navigate Your Challenges”, hosted by Businessincub and AlpsGenAI on 22 May 2025.

At the LEXcellence event “Shaping the Future: Legal & Regulatory Insights in new Technologies. Exploring AI, Cybersecurity, Fintech and Tax Regulations in the EU and Switzerland” hosted at Google Zurich, Stéphanie Fuchs delivered a presentation on the role of taxation in a rapidly evolving digital environment.

The focus was on how technology transforms tax systems - from international frameworks to data-based models and emerging digital risks.

Hosted in collaboration with Google’s team, the event brought together legal and regulatory experts to anticipate change rather than simply respond to it.

On February 25, 2025, the first edition of the event series Decoded Over Lunch: AI Agents Unleashed took place, moderated and organized by Stéphanie Fuchs.

World Economic Forum 2024

At the Women in Web3 Global Summit 2024, held during the Annual Meeting in Davos, Stéphanie Fuchs, joined Sarah Schlagenhauf, Aleksandra Ahrens, and Carolina Eugenia Cappabianca to explore the transformative potential of NFTs.

On July 4 and 5, 2024, the European DAO Workshop in Winterthur (DAWO24), organized by the Institute for Organizational Viability at the ZHAW School of Management and Law, brought together thought leaders to explore the evolving landscape of Decentralized Autonomous Organizations (DAOs).

Over two days, researchers, academics, practitioners, and consultants gathered to discuss how DAOs can foster innovation and inclusivity within democratic systems, leveraging the growing potential of blockchain technology.

The workshop served as a vibrant testbed for knowledge exchange and set the stage for future collaboration on advancing DAOs as a new organizational model.

During the event, Stéphanie Fuchs, alongside Andrea Trost from MLL Legal  and Florence Guillaume from the University of Neuchâtel, led an in-depth discussion on the critical tax and legal aspects of DAOs, and the adaptation of existing frameworks to accommodate this emerging structure. And yes, VAT was a major topic and subject to intense discussions.

The session offered valuable insights into both the benefits and challenges of implementing DAOs, sparking meaningful reflections on future needs and aspirations in the field.

DAWO24 was a significant milestone in advancing the conversation on DAOs, generating novel research opportunities and reinforcing the importance of continued collaboration among all stakeholders.
